1. Acceptance of Terms

By downloading, accessing, or using FuelUp (“the App”), a product of DeepStack Labs (“we,” “our,” or “us”), you agree to be bound by these Terms & Conditions. If you do not agree to these terms, please do not use the App.

2. The App

FuelUp is a nutrition and fitness tracking app. It provides AI-assisted food logging, personalized calorie/macro targets, meal suggestions, workout tracking, AI-generated workout plans, and progress insights. FuelUp is free to use, with an optional FuelUp Pro subscription for unlimited AI features and additional progress-tracking screens.

FuelUp is not a medical device and does not provide medical, nutritional, or fitness advice tailored to your individual health circumstances. Calorie/macro targets, AI meal suggestions, and AI-generated workout plans are general estimates. Talk to a qualified professional before making significant changes to your diet or exercise routine, especially if you have an existing health condition.

3. Accounts

To use FuelUp you create an account with an email address. You're responsible for the accuracy of the information you log and for keeping your account credentials secure. Notify us immediately at support@deepstacklabs.co if you suspect unauthorized use of your account.

4. FuelUp Pro Subscription

FuelUp Pro is an auto-renewing subscription billed through your Apple ID, available monthly or annually. Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period. You can manage or cancel your subscription at any time in your Apple ID account settings. Any unused portion of a free trial is forfeited when you purchase a subscription during the trial period. Prices are set and processed by Apple and may vary by region.

5. AI Features

Features that use AI — photo, voice, text, and label-based food logging, meal suggestions, AI-generated workout plans, the AI workout assistant, and weekly AI-written insights — produce estimates that can be inaccurate or incomplete. Always review AI-suggested results before relying on them, particularly for logged nutrition data.

6. Health Data

If you grant Apple HealthKit access, FuelUp reads your heart rate and active calories to display live stats during a workout, and — only if you separately enable workout sync — writes completed FuelUp workouts back to Health. You can revoke this access at any time in your device's Settings app.

7. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose, or log content that isn't yours or that violates someone else's rights.
• Attempt to gain unauthorized access to another user's account or our systems.
• Use bugs, exploits, or automation to manipulate the App's AI quotas, subscription entitlements, or personal records.
• Submit content through the AI features intended to manipulate, abuse, or extract unintended behavior from the underlying AI models.

8. Intellectual Property

All content, features, and functionality of FuelUp — including but not limited to text, graphics, logos, icons, and software — are the exclusive property of DeepStack Labs and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal purposes as permitted by these Terms.

9. Disclaimers

FuelUp is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components, or that any AI-generated content (nutrition estimates, workout plans, or insights) will be accurate.

10. Limitation of Liability

To the fullest extent permitted by law, DeepStack Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of FuelUp — including any decisions made based on the App's nutrition, fitness, or AI-generated content — even if we have been advised of the possibility of such damages.

11. Termination

We reserve the right to suspend or terminate your access to FuelUp at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Toronto, Ontario.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will indicate the date of the latest revision at the top of this page. Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms.
